This document establishes the General Conditions of Access and Use of the website guayparque.com, owned by Micaela Fontanella, (hereinafter Guayparque), with CIF X123456X and registered office at 4 Guirre street, 35660 La Oliva (Las Palmas),
The access and/or use of the website guayparque.com and tickets.guayparque.com by the users is conditioned to the previous reading and full, express and unreserved acceptance of the present General Conditions in force at the moment of the access. If the user does not agree with the present Conditions, he/she must abstain from using these webs and from operating on them. The user is fully aware that the mere browsing of this website, as well as the use of its services, implies acceptance of these Conditions.
Contractual Documentation Information
The present General Conditions of the different services that are made available to the user on the website guayparque.com and tickets.guayparque.com are permanently displayed on the website guayparque.com and tickets.guayparque.com, and all users may file them, print them and, therefore, be previously informed of the conditions of access and use of the site, as well as the contracting conditions under which the different services will be provided.

It is not technically possible for a user to finalize a contracting request without the acceptance of these General Conditions. The user by accepting these Conditions gives his express and unreserved consent for Guayparque to carry out the necessary collection operations for the provision of the services contracted. Therefore, the user gives his consent expressly authorizing Guayparque to make the charges in the methods of payment that he himself introduces from a secure area and, therefore, the operations that Guayparque performs, either by making a charge on his card or any other method of payment introduced by the Contracting Party, are considered authorized for the purposes of the regulations on payment services.
Any request for information, or claim that is considered pertinent, may be submitted to the Customer Service Department by sending an email to info@guayparque.com, including those documents that are considered pertinent.
Also, when the claim corresponds or is related to a Request for Return of purchase, the user must send an email to info@guayparque.com, within a period not exceeding seven days, calculated from the date of purchase, including in the email the supporting document of purchase that will have arrived to your email at the time of purchase, in addition to indicating the reasons for requesting a refund, also providing other documentation that may be relevant to the claim.
Our customer service department will contact you either to solve the incident, or to confirm the return of the purchase made if applicable, as soon as possible.
Object
The websites guayparque.com and tickets.guayparque.com have been created to provide professional booking services for Guayparque's facilities for birthday events and similar events, as well as for the purchase of tickets to enjoy the children's attractions located in our facilities, thus facilitating access by users to all the information about the characteristics of our facilities and our services. From the website guaparque.com and tickets.guayparque.com users can contract the services offered.
Conditions of Use
The use of the websites guayparque.com and tickets.guayparque.com does not entail the obligatory registration of the user. This registration will only be necessary in order to contract services, by entering certain data in a contracting form, where the present General Conditions are presented. The conditions of access and use of the websites guayparque.com and tickets.guayparque.com are strictly governed by current legislation and by the principle of good faith, and the user undertakes to make good use of them. Guayparque will not be responsible for errors, delays in access, or any anomaly that may arise in relation to problems of a general nature in the Internet network, force majeure or any other totally unforeseeable contingency beyond the good faith of the company.
Guayparque will not be responsible for the failures that for these causes can be produced in the communications, erased or incomplete transitions so that it does not guarantee that the web site is at all times operative when it is due to questions not attributable to Guayparque. The user exempts Guayparque from all responsibility if any of these causes begin to occur. Likewise, Guayparque will not be responsible in any case for the errors or damages produced by the inefficient and bad faith use of the website by the user. Likewise it will not be responsible for the consequences of the lack of communication between Guayparque and the contracting person when it is attributable to problems of malfunction of the email provided or the falsity of the data provided by the contracting person at the time.
Guayparque assumes the responsibilities that may arise from the provision of the services offered within the corresponding legal limits.
Access to our website is carried out under the exclusive responsibility of the user, who will be liable in all cases for any damages that may be caused to third parties or to Guayparque. The user assumes all responsibility derived from the use of the Web Site, being the only responsible for any direct or indirect effect on the web page generated, including any adverse economic, technical and/or legal result, as well as the disappointment of the expectations generated by the Web Site, obliging the user to maintain Guayparque indemnified for any claims derived, directly or indirectly from such facts, or of any produced by the breach of the present Conditions, as well as the development of any illicit activity or contrary to the General Conditions.
Protection of Personal Data
The data protection regime applicable to the data processed by Guayparque is regulated in the Privacy Policy and in the General Contracting Conditions of the corresponding Service. Access and/or use of the website by users of the website guayparque.com and tickets.guayparque.com, necessarily implies acceptance of these legal texts, consenting to the processing of data in the terms described in both texts.
Guayparque treats the personal data necessary for the provision of the services contracted or offered, and for the explicit purposes for which it obtains them, in a lawful, loyal and transparent manner.
Users are responsible for the veracity and up-to-dateness of the data they provide to Guayparque, and the data provided by them is considered accurate and up-to-dateness.
Communications and Jurisdiction
Guayparque and the user agree to communicate and notify each other of all incidents that may occur during the validity of the different services that may have been contracted, preferably and prior to any other means of communication, by e-mail. Guayparque's e-mail address for these communications will be info@guayparque.com and the user's e-mail address will be the one provided in the service contracting form at guayparque.com and/or tickets.guayparque.com or, failing that, the one used to contact Guayparque. The user undertakes to keep this e-mail operative and to communicate any modification that affects it, in order to be able to continue receiving the necessary communications. In any case, in case of any problem or failure in the functioning of the electronic mail of any of the parts, the communications will be made by telephone, fax, postal mail, courier or any other suitable system for the purpose that is pursued. However, the preferred means of communication is by e-mail, exempting Guayparque from any type of responsibility that may arise from the lack of consultation or error in the e-mail address provided by the user. Each of the parties will be responsible for the safekeeping and custody of the copies of the communications made.
These General Conditions are governed by Spanish law, being specifically subject to the provisions of the following regulations:
- Law 7/1988 of 13 April 1988, on General Contracting Conditions;
- Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws;
- General Data Protection Regulation and Organic Law 3/2018, of 5 December, on Personal Data Protection and guarantee of digital rights;
- Law 7/1996 of 15 January 1996 on the Regulation of Retail Trade;
- Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce;
- Law 16/2009, of 13 November, on payment services;
As well as any other regulation that develops, modifies or replaces them.
The Courts and Tribunals of Puerto del Rosario, Fuerteventura, province of Las Palmas shall be competent for the resolution of any controversy or conflict arising from these General Conditions, and the contracting party expressly waives any other jurisdiction to which it may be entitled.
